Wolfgang Streeck has written extensively on comparative political economy and institutional theory. By exploring different approaches to the study of labour law, this book re-evaluates how it is conceived, analysed, and criticized in current legislation and policy. In particular, it assesses whether so-called 'old ways' of thinking about the subject, such as the idea of the labour constitution, developed by Hugo Sinzheimer in the early years of the Weimar Republic, and the principle of collective laissez-faire, elaborated by Otto Kahn-Freund in the 1950s, are in fact outdated. It asks whether, and how, these ideas could be abstracted from the political, economic, and social contexts within which they were developed so that they might still usefully be applied to the study of labour law. Dukes argues that the labour constitution can provide an 'enduring idea of labour law', and an alternative to modern arguments which favour reorienting labour law to align more closely with the functioning of labour markets. Unlike the 'law of the labour market', the labour constitution highlights the inherently political nature of labour laws and institutions, as well as their economic functions. It constructs a framework for analysing labour laws, labour markets, and institutions, to allow scholars to critique the current policy climate and, in light of the ongoing expansion of the global labour market, assess the impact of the narrowing and disappearance of spaces for democratic deliberation and democratic decision-making on workers' rights.

There have been numerous accounts exploring the relationship between institutions and firm practices. However, much of this literature tends to be located into distinct theoretical-traditional 'silos', such as national business systems, social systems of production, regulation theory, or varieties of capitalism, with limited dialogue between different approaches to enhance understanding of institutional effects. Again, evaluations of the relationship between institutions and employment relations have tended to be of the broad-brushstroke nature, often founded on macro-data, and with only limited attention being accorded to internal diversity and details of actual practice. As unions in most other industrialized democracies continue to decline, unions in Spain have been able to regain and maintain strength despite unfavorable institutional, political, and economic conditions. The Politics of Industrial Relations provides a comprehensive analysis of Spanish unions from the Franco dictatorship until the present. It builds on industrial relations, comparative politics, and political economy literature to investigate the trajectory of Spanish unions. The book analyzes unions as political actors, that is, their interaction and involvement with governments, political parties, and nationwide policy-making processes to explain why Spanish unions appear in some ways as atypical in West European comparison. The development of Spanish unions and industrial relations is framed in a historical-institutionalist approach while also taking into account globalization and Europeanization processes. Using the case of the Spanish transition to democracy, the book demonstrates that the historical sequencing of institutional reforms in the political and industrial relations arenas holds significant and long-lasting consequences for the nature of unions and labor relations. The book concludes that by understanding unions as political actors, the history of Spanish unionism and industrial relations institutions is more easily accommodated than looking at unions as industrial actors alone. In a radio broadcast in 1939 Winston Churchill defined Russia in a famous quip as ‘a riddle wrapped in a mystery inside an enigma.’ The chain of metaphors in Churchill’s famous maxim was to point the difficulty of making sense of the great political transformation Russia had gone through. Though perplexed, Churchill had a key to solve the Russian riddle: the national interest or more precisely ‘historic-life interests.’ The ‘new Middle East’ is also a riddle inside an enigma rolled up in a puzzle mat. The former is difficult to grasp even with metaphors. The national interest is not a ‘key’ either, for it appears more of a political ploy than an analytical edifice that can hardly be applicable to the haplessly artificial regional states. The enigma of the ‘Arab Spring,’ the mystery of the ISIL, the riddle of Russian intervention in Syria and the puzzle of Turkish national interests in the Middle East are few items in the long list of explanandum.

This volume presents the first thorough sociologically-informed legal analysis of the financial crisis which unfolded in 2008. It combines a multitude of theoretically informed analyses of the causes, dynamics and reactions to the crisis and contextualises these within the general structural transformations characterising contemporary society. It furthermore explores the constitutional implications of the crisis and suggests concrete changes to the constitutional set-up of contemporary society. Although the question of individual responsibility is of crucial importance, the central idea animating the volume is that the crisis cannot be reduced to a mere failure of risk perception and management for which individual and collective actors within and outside of financial organisations are responsible. The 2008 crisis should rather be understood as a symptom of far deeper structural transformations. For example contemporary society is characterised by massive accelerations in the speed with which societal processes are reproduced as well as radical expansions in the level of globalisation. These transformations have, however, been asymmetrical in nature insofar as the economic system has outpaced its legal and political counterparts. The future capability of legal and political systems to influence economic reproduction processes is therefore conditioned by equally radical transformations of their respective operational forms and self-understanding. Potentially the 2008 crisis, therefore, has far-reaching constitutional implications.

Since the 1980s, the process of European economic integration, within a wider context of globalization, has accelerated employment change and placed a new premium on ‘flexible’ forms of work organization. There is a highly significant and under-considered intersection and interaction between migration law and labour law. Labour lawyers have tended to regard migration law as generally speaking outside their purview, and migration lawyers have somewhat similarly tended to neglect labour law. The culmination of a collaborative project on 'Migrants at Work' funded by the John Fell Fund, the Society of Legal Scholars, and the Research Centre at St John's College, Oxford, this volume brings together distinguished legal and migration scholars to examine the impact of migration law on labour rights and how the regulation of migration increasingly impacts upon employment and labour relations. Examining and clarifying the interactions between migration, migration law, and labour law, contributors to the volume identify the many ways that migration law, as currently designed, divides the objectives of labour law, privileging concerns about the labour supply and demand over worker-protective concerns. In addition, migration law creates particular forms of status, which affect employment relations, thereby dividing the subjects of labour law. Chapters cover the labour laws of the UK, Australia, Ireland, Israel, Italy, Germany, Sweden, and the US. References are also made to discrete practices in Brazil, France, Greece, New Zealand, Mexico, Poland, and South Africa. These countries all host migrants and have developed systems of migration law reflecting very different trajectories. Some are traditional countries of immigration and settlement migration, while others have traditionally been countries of emigration but now import many workers. There are, nonetheless, common features in their immigration law which have a profound impact on labour law, for instance in their shared contemporary shift to using temporary labour migration programmes. Further chapters examine EU and international law on migration, labour rights, human rights, and human trafficking and smuggling, developing cross-jurisdictional and multi-level perspectives.
