A Treatise of Legal Philosophy and General Jurisprudence is the first-ever multivolume treatment of the issues in legal philosophy and general jurisprudence, from both a theoretical and a historical perspective. The work is aimed at jurists as well as legal and practical philosophers. Edited by the renowned theorist Enrico Pattaro and his team, this book is a classical reference work that would be of great interest to legal and practical philosophers as well as to jurists and legal scholar at all levels. The work is divided in two parts. The theoretical part (published in 2005), consisting of five volumes, covers the main topics of the contemporary debate; the historical part, consisting of six volumes (Volumes 6-8 published in 2007; Volumes 9 and 10, published in 2009; Volume 11 published in 2011 and Volume 12 forthcoming in 2016), accounts for the development of legal thought from ancient Greek times through the twentieth century. Volume 12 Legal Philosophy in the Twentieth Century: The Civil Law World Volume 12 of A Treatise of Legal Philosophy and General Jurisprudence, titled Legal Philosophy in the Twentieth Century: The Civil-Law World, functions as a complement to Gerald Postema’s volume 11 (titled Legal Philosophy in the Twentieth Century: The Common Law World), and it offers the first comprehensive account of the complex development that legal philosophy has undergone in continental Europe and Latin America since 1900. In this volume, leading international scholars from the different language areas making up the civil-law world give an account of the way legal philosophy has evolved in these areas in the 20th century, the outcome being an overall mosaic of civil-law legal philosophy in this arc of time. Further, specialists in the field describe the development that legal philosophy has undergone in the 20th century by focusing on three of its main subjects—namely, legal positivism, natural-law theory, and the theory of legal reasoning—and discussing the different conceptions that have been put forward under these labels. The layout of the volume is meant to frame historical analysis with a view to the contemporary theoretical debate, thus completing the Treatise in keeping with its overall methodological aim, namely, that of combining history and theory as a necessary means by which to provide a comprehensive account of jurisprudential thinking.

The main item in the present volume was published in 1930 under the title Das Unendliche in der Mathematik und seine Ausschaltung. It was at that time the fullest systematic account from the standpoint of Husserl's phenomenology of what is known as 'finitism' (also as 'intuitionism' and 'constructivism') in mathematics. Since then, important changes have been required in philosophies of mathematics, in part because of Kurt Godel's epoch-making paper of 1931 which established the essential in completeness of arithmetic. In the light of that finding, a number of the claims made in the book (and in the accompanying articles) are demon strably mistaken. Nevertheless, as a whole it retains much of its original interest and value. It presents the issues in the foundations of mathematics that were under debate when it was written (and in some cases still are); , and it offers one alternative to the currently dominant set-theoretical definitions of the cardinal numbers and other arithmetical concepts. While still a student at the University of Vienna, Felix Kaufmann was greatly impressed by the early philosophical writings (especially by the Logische Untersuchungen) of Edmund Husser!' He was never an uncritical disciple of Husserl, and he integrated into his mature philosophy ideas from a wide assortment of intellectual sources. But he thought of himself as a phenomenologist, and made frequent use in all his major publications of many of Husserl's logical and epistemological theses.

This volume contains the English translation of Felix Kaufmann's (1895-1945) main work Methodenlehre der Sozialwissenschaften (1936). In this book, Kaufmann develops a general theory of knowledge of the social sciences in his role as a cross-border commuter between Husserl's phenomenology, Kelsen's pure theory of law and the logical positivism of the Vienna Circle. This multilayered inquiry connects the value-oriented reflections of a general philosophy of science with the specificity of the methods and theories of the social sciences, as opposed to abstract natural science and psychology. The core focus of the study is the attempt to elucidate how and under what conditions scientific knowledge about social facts, empirically justified and theoretically embedded, can be obtained. The empirical basis of knowledge within the social sciences forms a phenomenological concept of experience. According to Kaufmann, this concept of experience exhibits a complex structure. Within the meaning-interpretation of human action as the core of knowledge in the social sciences, this structure reaches out across the isolated act of verification toward the synthesis of external and internal experiences. The book opens with a detailed and useful introduction by Ingeborg K. Helling, which introduces the historical and theoretical background of Kaufmann's study and specifically illuminates his relation to Alfred Schütz and John Dewey. Finally, it contains interviews with and letters to members of his family, colleagues and students.

In English-speaking countries Victor Kraft is known principally for his account of the Vienna Circle. ! That group of thinkers has exercised in recent decades a significant influence not only on the philosophy of the western world, but also, at least indirectly, on that of the East, where there is now taking place a slow but clearly irresistible erosion of dogmatic Marxism by ways of think ing derived from a modem scientific conception of the world. Kraft's work as historian of the Vienna Circle has led to his being classed, without further qua1ification, as a neo-positivist philosopher. It is, however, only partially correct to count him as such. To be sure, he belonged to the group named, he took part in its meetings, and he drew from it suggestions central to his own work; but he did not belong to the hard core of the Circle and was a con scious opponent of certain radical tendencies espoused, at least from time to time, by some of its members. Evidence of this is provided by the theory of value now presented in English translation, since no less a thinker than Rudolf Carnap had, originally at any rate, obeyed a very narrowly conceived criterion of sense and declared value judgements to be senseless.
