English summary: Several years of application of the modernized law of obligations of the German Civil Code (BGB) and increasing Europeanization of contract law call for an intermediate assessment and raise the question of the prospects. Specific features of the modernized German law of obligations, proposals or considerations for modernizing the law of obligations in other European countries as well as fundamental questions of the development of a European contract law here are tackled by leading experts from Germany and nine other European nations. Impossibility, damages, frustration, hierarchy of remedies, culpa in contrahendo are among the areas analyzed, and views on modernization or Europeanization of the law of obligations are given from colleagues from France, Italy, Netherlands, Spain, Hungary, the United Kingdom, Greece and Switzerland. English summary: The essays collected here investigate the extent to which existing EC private law, the 'Acquis Communautaire', outlines general guidelines for the future development of European contract law. The work documents the results of new research carried out by the Acquis Group. The Acquis Communautaire is analyzed with the aim of revealing common principles as a basis for further harmonization of European contract law. Thus the essays give preliminary answers to the Action Plan of the European Commission, dating from February 2003, which calls for a 'more coherent European contract law'. The Acquis Group â?? also known as the European Research Group on Existing EC Private Law â?? pursues the objective of presenting, in a restated form known as the Acquis Principles, the large and sometimes incoherent patchwork of existing EC private law.
