English summary: Is the term legal science an oxymoron? American legal scholars would deny this. For the top law schools, it is obvious that academic law is a social science. Many law professors hold a Ph.D. in economics, political science, sociology, psychology or another neighbouring field. They routinely publish in peer-review journals, no less than their colleagues from the social sciences. They define their research questions the way all social scientists do, which means setting out at defining one effect or testing it empirically. A separate discourse aims at fleshing out implications for legal practice. This predominantly takes place in student-run law reviews. However this discourse as well is often not problem-driven. It explores the legal implications of an effect well established in theory or empirical research. German legal academia differs considerably from this. German description: Was macht Recht zur Wissenschaft? Dieser Frage gehen die Autoren der hier gesammelten Aufsatze nach. Die Juristerei ist eine selbstbewusste Disziplin. Die offensichtliche praktische Bedeutung des Fachs bietet ihr Schutz vor Selbstzweifeln. Der Hunger der Praxis nach Heerscharen gut ausgebildeter Juristen tut ein Ubriges. Doch im universitaren Wettbewerb der Facher sind beides eher schwache Argumente. Noch beunruhigender ist, dass viele dogmatische Argumente auf sozialwissenschaftlichen Konzepten grunden. Schon in der Rechtsanwendung fuhrt dies zu Friktionen: Ein Gericht kann weder mit einem exakten mathematischen Modell etwas anfangen noch mit Regressionen, die so gut spezifiziert sind, dass der Fehlerterm normalverteilt ist. Wenn man die Juristerei fur harte Sozialwissenschaften offnet, kommt das Fach also nicht ohne Vermittler aus. Noch prekarer ist die Lage in der Rechtspolitik: Konnen Juristen den Gesetzgeber mit eigener wissenschaftlicher Autoritat beraten oder lassen sich die Regelungsziele guter Gesetzgebung besser aus der Perspektive von Okonomen, Psychologen oder Soziologen definieren? Die traditionell fraglose Einheit von Wissenschaft und Praxis wird zu einem voraussetzungsvollen Unterfangen. Nicht zuletzt mag manch ein juristischer Wissenschaftler versucht sein, sich ganz auf die Position des Beobachters zuruckzuziehen. Dann ist das Recht bloss noch Forschungsgegenstand. Einen Beitrag zur Entwicklung der Dogmatik will solch ein Wissenschaftler nicht mehr leisten. Dies fuhrt zu der Frage nach der Eigenstandigkeit der Rechtslehre im Konzert der Wissenschaften - der Frage nach dem Proprium der Rechtswissenschaft.
