This book considers the case for modernising partnership rights in EC family reunification law. Existing Community law traditionally guarantees immigration rights only to spouses and yet there is a growing diversity of national laws on same-sex marriage, registered partnerships and recognition of cohabitation. The Community institutions which have recently framed new legislation seem to view this as a question that can be settled by political agreement with little or no outside constraint. The book challenges this assumption. The book outlines recent developments in national legal systems and traces the development of the recent Community legislation. Then, drawing on basic ECHR principles, the place of the ECHR in Community law, and on basic Community law principles of free movement and discrimination the book argues that the right of a migrant EU Citizen to family reunification for a cohabiting partner is presumptively protected and therefore justification for refusing to admit such partners must be provided. It also considers the possible justifications for marriage-partners only immigration policies and concludes that although possible, such justifications are far from certain to succeed. The discussion also tackles the question of whether judicial activism is appropriate or whether there should be judicial deference to the legislative process recently completed. The book concludes with a wider discussion of the proper response of Community law to the increasing diversity of Member States family laws and policies beyond the field of immigration rights.

English summary: The Max Planck Institute for Foreign Private and Private International Law has conducted an analysis of the legal status of transsexuals in Europe America and Australia. The book is based on an expert opinion for the German constitutional court, in view of the constitutional challenge of the German law on transsexuals. It was submitted, that the requirement of German nationality for legal recognition of a gender change in Germany violated the German constitution. The expert opinion states that this requirement not only violates the German constitution, but also the European Convention on Human Rights. The authors suggest alternatives to the current legal rule. German description: Das Buch geht auf ein Gutachten zuruck, das vom Max-Planck-Institut fur auslandisches und internationales Privatrecht im April 2004 fur das Bundesverfassungsgericht erstattet wurde. Anlass war ein konkretes Normenkontrollverfahren, in dem das Gericht vor die Frage gestellt wurde, ob es mit dem Gleichheitssatz des Grundgesetzes vereinbar sei, dass nach dem deutschen Transsexuellengesetz nur deutsche Staatsburger oder Personen mit deutschem Personalstatut den Antrag auf Anerkennung einer Geschlechtsumwandlung stellen durfen.Zur Klarung dieser Frage wird zunachst der verfassungsrechtliche Rahmen auf der Grundlage fruherer Urteile des BVerfG skizziert. Es folgen Darstellungen der Rechtslage in 18 Landern (Europa, Australien, Amerika) mit einer zusammenfassenden Analyse sowie eine Untersuchung von Urteilen des EuGHMR zur Europaischen Menschrechtskonvention (EMRK) und des EuGH. Schliesslich werden Alternativen zur bestehenden deutschen Regelung aufgezeigt. Im Ergebnis zeigt sich, dass die in Frage stehende Norm des deutschen Transsexuellengesetzes gegen das Grundgesetz und gegen die EMRK verstosst, so dass eine neue Regelung nach dem Vorbild der geschilderten Alternativen geschaffen werden sollte.

The first part of the book critically evaluates the evolution of the separate intra-EU child abduction regime and examines the extent to which the European Union complied with its standards of good legislative drafting during the negotiations on the Brussels II bis Regulation. The Charter of Fundamental Rights of the European Union enshrines the key political, social and economic rights of EU citizens and residents in EU law. The law of succession, which has been traditionally confined to domestic limits, is becoming a frequent topic of discussion in international forums, due to the increasing mobility of people and assets. Freedom of testation is in the center of all initiatives tending to harmonize or at least approximate legislations in this field, even if, to date, efforts in this direction have focused on international private law. In April 2010, an international conference was held in Barcelona, where the scope of freedom of testation was checked against the limitations imposed by human rights, by domestic rules granting forced shares and other rights to the deceased's next of kin, and by provisions dealing with inheritance agreements. The conference stemmed from the new Catalan legislation and proceeded to cover other national systems. These reports, together with other contributions by experts from various countries, address continental Europe's domestic regulations, the English common law system, and Eastern European solutions. A general overview on the need and opportunity of convergence in the law of succession and on the proposed EU Regulation on Successions and Wills - as an initial move towards harmonization - are broached from the outset. The diversity of solutions that this volume presents confirms its convenience.
