Jahrhundert.

Freedom of Artistic Expression

Essays on Culture and Legal Censure

This book presents a unique and comprehensive examination of the human and moral rights of artists. In what is arguably the first exhaustive book-length account of artists' rights, Paul Kearns explores the problems associated with censorship, both from philosophical and legal perspectives, and focuses on the various ways in which the morality of art is legally regulated in different jurisdictions. In relation to human rights, English, French and American law, the law of the European Convention on Human Rights, European Union law and public international law are all closely scrutinised to discover the extent to which they offer protection for artistic freedom. The author also examines domestic and international law in respect of artists' moral rights, the law of copyright and related laws. In short, the book provides an original, and sometimes controversial, analysis of persistent concerns regarding the legal regulation of the arts universally, doctrinally and theoretically, and seeks to offer an holistic treatment which will appeal to art lawyers, artists and those interested in the future of the arts.

Too Much Free Speech?

"In this project Randall Bezanson examines judicial interpretations of free speech by means of a broad range of Supreme Court cases, arguing that over the past 15 years the Court has engaged in a truly revolutionary expansion of the reach of the free speech guarantee. The cases include the much-discussed Citizens United decision which granted the full measure of constitutional protection to speech by corporations; the Doe v. Reed case from Washington State that recognized the acts of signing petitions and voting in elections as acts of free speech; the Summum decision holding that the decision to select a monument for a public park and to reject another based on the government's disagreement with the monument's message is an act of government speech immunized from challenge by the First Amendment; and the Hurley and Dale cases that recognized free speech claims for messages and meanings that arose "out of thin air": speech without an author (a parade); and an author without a message (the Boy Scouts). As in earlier books on freedom of the press and of religion, Bezanson aims to arm the reader with the capacity to reach her or his own decision about whether the Court's conduct befitted the independent judicial branch and the consequences of its decisions for a representative democracy"--Provided by publisher.

Freedom of Speech and Islam

Freedom of speech and expression is considered in the West a high public good and an important social value, underpinned by legislative and ethical norms. Its importance is not shared to the same extent by conservative and devout Muslims, who read Islamic doctrines in ways seemingly incompatible with Western notions of freedom of speech. Since the Salman Rushdie affair in the 1980s there has been growing recognition in the West that its cherished value of free speech and associated freedoms relating to arts, the press and media, literature, academia, critical satire etc. episodically clash with conservative Islamic values that limit this freedom for the sake of holding religious issues sacrosanct. Recent controversies - such as the Danish cartoons, the Charlie Hebdo affair, Quran burnings, and the internet film ‘The Innocence of Muslims’ which have stirred violent reactions in the Muslim world - have made the West aware of the fact that Muslims’ religious sensitivities have to be taken into account in exercising traditional Western freedoms of speech. Featuring experts across a spectrum of fields within Islamic studies, Freedom of Speech and Islam considers Islamic concepts of blasphemy, apostasy and heresy and their applicability in the modern world.

Importing European and US Constitutional Models in Transitional Democracies

Author: Uladzislau Belavusau

This book considers the issue of free speech in transitional democracies focusing on the socio-legal developments in the Czech Republic, Hungary, and Poland. In showing how these Central and Eastern European countries have engaged with free speech models imported from the Council of Europe / EU and the USA, the book offers valuable insights into the ways States have responded to challenges associated with transformation from communism to Western democracy. The book first explores freedom of expression in European and American law looking particularly at hate speech, historical revisionism, and pornography. It subsequently enquires into the role and perspectives of those European (mandatory) and US-American (persuasive) models for the constitutional debate in Central and Eastern Europe. The study offers an original interpretation of the "European" model of freedom of expression, beyond the mechanisms of the Council of Europe. It encompasses the relevant aspects of EU law (judgments of the Court of Justice and the harmonised EU instruments) as mandatory standards for courts and legislators, including those in transitional countries of Central and Eastern Europe. The book argues for de-criminalisation of historical revisionism and pornography, and illuminates topics such as genocide denial, the rise of Prague and Budapest as Europe’s porno-capitals, anti-Semitism and anti-Gypsyism, religious obscurantism and homophobia, virulent Islamophobia, and the glorification of terrorism. The research methodology in this study combines a descriptive case law assessment (comparative constitutional, public international, and EU law) with a normative critique stemming from post-structuralist scrutiny, rhetoric, postmodern legal movements, legal history, history of ideas, and art criticism. This book will be of interest to students and scholars of, comparative constitutional law, law and society, human rights and European law as well as political philosophers.

Cover Up the Dirty Parts! Arts Funding, Fighting, and the First Amendment

Cover Up the Dirty Parts! takes on directly not only questions regarding the relationship between government funding for the arts and political censorship, but also deeper philosophical questions regarding liberty, the definition of art, the role of vague terms in language and law, and the epistemological role of both free expression and art itself. The issue of arts funding sits in the terrain of overlap between aesthetics and political philosophy and thus elicits aesthetic questions regarding the purpose of art and how art is defined, political questions regarding the nature of freedom and the role of government, and epistemological questions regarding the sources of knowledge and how it is we acquire it. As both an analytic philosopher and a practicing artist, Shottenkirk has incorporated the insights and sensitivities of both worlds in this analysis of why art is important and why freedom of expression within cultural development must be respected if we are to embrace a society able to provide the maximum degree of stimulation and safety for all its members. In this context, art is viewed as valuable both as a tool for knowledge acquisition for the individual and as a source of consensus building for the culture. As a device for consensus building, art has the role of practicing respect for differing opinions and balancing competing points of view as well as serving as self-expression for the individual. Interviews with two artists, the first of whom is an American central to the funding debates of the last few decades and the second of whom is a contemporary Iranian writer imprisoned for her writing, combine with both narrative and philosophical analysis to give a complete picture of the issues and what is at stake for all of us who care not only about art but about freedom as well. While the distinction between censorship and non-funding is explored, also analyzed is the need for tolerance in the face of offense as well as respect for others’ rights and cultural differences.

The Supreme Court has unanimously held that Jackson Pollock’s paintings, Arnold Schöenberg’s music, and Lewis Carroll’s poem “Jabberwocky” are “unquestionably shielded” by the First Amendment. Nonrepresentational art, instrumental music, and nonsense: all receive constitutional coverage under an amendment protecting “the freedom of speech,” even though none involves what we typically think of as speech—the use of words to convey meaning. As a legal matter, the Court’s conclusion is clearly correct, but its premises are murky, and they raise difficult questions about the possibilities and limitations of law and expression. Nonrepresentational art, instrumental music, and nonsense do not employ language in any traditional sense, and sometimes do not even involve the transmission of articulable ideas. How, then, can they be treated as “speech” for constitutional purposes? What does the difficulty of that question suggest for First Amendment law and theory? And can law resolve such inquiries without relying on aesthetics, ethics, and philosophy? Comprehensive and compelling, this book represents a sustained effort to account, constitutionally, for these modes of “speech.” While it is firmly centered in debates about First Amendment issues, it addresses them in a novel way, using subject matter that is uniquely well suited to the task, and whose constitutional salience has been under-explored. Drawing on existing legal doctrine, aesthetics, and analytical philosophy, three celebrated law scholars show us how and why speech beyond words should be fundamental to our understanding of the First Amendment.

Speech Matters

Getting Free Speech Right

Author: Professor of Politics and Public Policy Katharine Gelber

ISBN: 0702247324

"Why are Australians getting free speech Wrong? Australia is the land of the 'Fair Go'. But does this extend to giving everyone the right to speak freely about politics? While most Australians take this vital freedom for granted, in Speech Matters political analyst Katharine Gelber shows why many of Australia's laws and policies are actually damaging our democratic ideals. A council officer shuts down a Sydney art exhibition that challenges the basis for the Iraq war; big day out organisers are attacked for asking attendees not to wear the Australian flag after the Cronulla riots. Gelber investigates a wide range of political expression to discover what value Australians place on free speech: from the national flag, hate speech and anti-terrorism laws to protest, campaigns against corporate actions and provocative art. Gelber considers the rules that regulate our speech and actions alongside the views of everyday Australians on these issues. What Gelber finds is a political culture that is failing free speech. In Australia, powerful companies can silence dissent, and even peaceful protest can be difficult to carry out. Filled with controversial examples to fuel the debate, Speech Matters challenges Australians to rethink freedom of speech. It's time to give everyone a voice in running the country."--Publisher's website.
